Why throat dampers stop sealing
The damper most houses have is a metal plate at the throat of the firebox, sitting in the path of everything going up and everything coming down. Soot and grit build on the seat and the plate warps with heat over decades.
Even when it works it is metal on metal, designed to close rather than to seal. And in California an enormous number have been deliberately fixed part-open for a vented gas log set, which is correct for the appliance and permanent for the house.
What the gas conversion did
Vented gas log sets generally require the damper to be permanently fixed part-open so combustion products cannot spill into the room. That is a code requirement, not an installer shortcut — but the consequence is an opening in the building that stays there year- round.
Repair before replacement
A seized damper is often just fouled. Cleaning the seat and pivot and freeing the mechanism restores it.
Top-sealing dampers and gas appliances
A top-mount damper closes over the flue at the crown with a silicone gasket, sealing far better than any throat damper, and it doubles as a rain cap. On a wood-burning or unused fireplace it is usually the better answer.
Where a vented gas appliance is installed, whether any damper may close at all depends on the appliance and on code. That is a question to settle before fitting anything, not after.

How do I know if mine seals?
Look up into the throat with a light. It should sit flat when closed. A draft with it shut and no fire lit means it is not sealing — or that it has been fixed open deliberately.
Ours is clamped open. Is that wrong?
Not necessarily — it is usually required for a vented gas log set. It does mean the opening is permanent, and a top-mount damper is not an option while that appliance is in place.
Is a top-mount worth it?
On a wood-burning or unused fireplace, yes. It seals properly, keeps the flue dry and replaces the cap.
Mine is rusted solid.
Often freeable by cleaning the seat and pivot. A cracked or warped plate is the point to consider replacement.
Can I leave it open?
Only with a fire or live embers present, unless a gas appliance requires otherwise.
